A prenuptial agreement (“prenup” or “premarital agreement”) is a written contract created by two people before they get married.  A properly prepared prenup should make it clear what property is community property and what property is separate property, as well as state what obligation, if any, one spouse will have to provide spousal support to the other spouse if the marriage ends in divorce.

The prenup typically specifies what each person’s property rights will be after the marriage ends, whether it ends by divorce or death.  Couples, with or without children, wealthy or not, may simply want to clarify their financial rights and responsibilities during the marriage as well as if the marriage ends.  A prenup is often the best way to do this and avoid conflict later. With a prenup, couples can avoid potential arguments in the event of divorce by specifying in advance how property is to be divided, and whether or not either spouse will receive alimony.
